Bright Servers LLC ("Bright Servers," "we," "us," or "our") provides legal process serving and related litigation support services throughout Peoria, Tazewell, Knox, Woodford, Macon, and Sangamon Counties, Illinois. This Privacy Policy explains how we collect, use, disclose, and safeguard information in connection with our website (the "Site") and our process serving services.

Because our business involves serving legal documents, we necessarily collect and handle personal information about individuals who are not our clients — namely, the parties we are hired to locate and serve. This policy addresses both our website visitors/clients and the individuals involved in service of process, since the privacy considerations differ for each.

By using our Site or engaging our services, you acknowledge the practices described in this policy. This document is provided for general informational purposes and does not constitute legal advice.

When a law firm, business, or individual retains Bright Servers to perform process serving or related services, we may collect:

• Client contact information (name, firm name, address, phone number, email)
• Billing and payment information
• Case-related information, including case numbers, court names, and the legal documents to be served
• The name, address, physical description, employer, vehicle information, and other identifying or locating details of the person(s) to be served
• Special instructions related to service attempts (e.g., known schedules, safety concerns, aliases)

In the course of performing process service, we may collect and record:

• The date, time, and location of service attempts and completed service
• Description of the individual served and how identity was confirmed
• Photographs, GPS coordinates, or notes documenting the service (used to support affidavits of service)
• Information obtained through skip tracing or public records searches when a subject's location is not initially known

This information is collected to fulfill our legal function of properly effecting and documenting service of process and is generally required to produce a valid affidavit of service for court purposes.

When you visit brightservers.com or contact us through the Site, we may automatically or directly collect:

• Contact form submissions (name, email, phone number, message content)
• Technical data such as IP address, browser type, device type, and pages visited
• Cookies and similar tracking technologies used for basic site analytics (see Section 9)

We do not knowingly collect payment card numbers directly through the Site; payments are processed through a secure third-party payment processor.

We use the information described above to:

• Perform, document, and verify service of process and related legal support services
• Locate individuals who need to be served, using lawful skip tracing and public records methods
• Prepare affidavits of service and other documentation required by courts or clients
• Communicate with clients regarding case status, scheduling, and invoicing

We do not use information collected about individuals we are hired to serve for marketing purposes, and we do not sell that information.

Bright Servers processes personal information about parties to be served based on the legitimate business interest of fulfilling a contracted legal service — namely, effecting service of process on behalf of a client in connection with active litigation or legal proceedings. Illinois law and court rules governing service of process authorize and, in many cases, require the collection of this information to establish valid service.

We may share information with:

• Clients: Attorneys, law firms, businesses, or individuals who retained us, receiving affidavits of service, status updates, and related documentation
• Courts: As required to file proof of service
• Service providers: Third parties who support our operations, such as payment processors, skip tracing databases, and case management or scheduling software
• Legal and regulatory authorities: Where required by law, subpoena, court order, or to establish, exercise, or defend legal claims
• Successors: In connection with a merger, acquisition, or sale of business assets

Consumer personal data is not transferred to external organizations except: (a) where necessary to provide the services a client or customer has requested (for example, sharing case information with a court, or using a service provider listed above to support service of process); or (b) where required by law, subpoena, court order, or valid legal request. We do not sell personal information, and we do not transfer, share, or disclose personal data to any third party for marketing or promotional purposes, under any circumstances.

Mobile opt-in data. We do not transfer mobile opt-in and consent data (i.e., your consent to receive text messages from us, and your mobile phone number collected in connection with that consent) to any external organization under any circumstances, including with your consent, except where strictly required by law. Any information-sharing described elsewhere in this policy does not apply to mobile opt-in data.

We maintain policies and safeguards designed to prevent unauthorized sharing of mobile opt-in data, including access controls limiting which personnel can view or use this information, confidentiality obligations for employees who handle it, restrictions imposed on any vendor or platform involved in sending text messages, and periodic review of our security practices.

1. Program description. The messaging program consists of informational messages used to provide status updates and support to customers.
2. Opting out. You can cancel the SMS service at any time by texting STOP to the number from which you received messages. After you send STOP, we will send a confirmation SMS that you have been unsubscribed, and you will not receive further messages from us. If you want to rejoin, sign up the same way you did the first time and we will resume sending messages.

4. Carrier liability. Carriers are not liable for delayed or undelivered messages.
5. Message and data rates. Message and data rates may apply to messages sent to and from us. Message frequency varies based on communication needs. Contact your wireless provider with questions about your text or data plan.
6. Privacy. Questions about how we handle your information in connection with this program are addressed throughout this Privacy Policy, including the mobile opt-in protections described above.

We retain case files, affidavits of service, and related records for as long as necessary to comply with Illinois legal and licensing requirements, to support potential litigation regarding the validity of service, and consistent with our internal record retention practices. Website contact form submissions are retained only as long as needed to respond to and resolve the inquiry, unless a business relationship follows.

We maintain administrative, technical, and contractual safeguards designed to protect personal information against unauthorized access, use, or disclosure, including:

• Administrative controls: Limiting access to client, case, and subject information to personnel who need it to perform their job duties; internal policies governing the handling of sensitive case and personal data.
• Technical controls: Secure storage of case files and electronic records, password-protected systems and devices, and secure handling of data within our case management and scheduling platforms.
• Contractual controls: Requiring service providers that process personal information on our behalf (such as our payment processor) to maintain appropriate confidentiality and security obligations.
• Physical controls: Restricted physical access to printed case files and documentation.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If we become aware of a security incident affecting personal information, we will take appropriate steps consistent with applicable law.

Because this information supports a legal affidavit and may be required by a court, we are generally unable to delete or alter records of completed service upon request. Questions about the underlying legal matter should be directed to the attorney or party who initiated the case, or to the court itself.

As an Illinois-based business, Bright Servers complies with applicable Illinois privacy and consumer protection laws. If Illinois enacts or amends comprehensive privacy legislation applicable to our operations, we will update this policy accordingly.

Our Site and services are not directed to individuals under 18, and we do not knowingly collect personal information from children through the Site.

Our Site may contain links to third-party websites. We are not responsible for the privacy practices or content of those sites and encourage you to review their privacy policies.
